Claims, Family Provision, Capacity, Undue Influence

Contested estate claims and other estate disputes often arise betwen family members and other potential beneficiaries after a person dies.  We handle many contested estate claims and estate disputes every year and are one of the most experienced law firms in Sydney in this area.  If a person dies without making a will or a will has not been prepared in a way which takes into account potential estate claims, the chances of a claim against the estate or a challenge to the will are increased.  If someone dies without making a will, the result can be that there are relatives who are left without adequate financial provision and who can make a claim against the estate.

In some cases, the circumstances in which a will was made or the fact that the person making the will was ill or incapacitated can give rise to claims by relatives or others regarding the validity of the will or the manner in which the estate should be administered and distributed.
